1. Agreement to Terms

By scheduling, confirming, paying for, or allowing Turf Cleaning San Diego to begin work on your property, you acknowledge and agree to these Terms & Conditions in full. These terms apply with or without a physical signature and form a binding legal agreement.

2. Scope of Services

Turf Cleaning San Diego provides artificial turf cleaning and maintenance services, including:

• Pet waste removal
• Odor and bacteria treatment
• Disinfection and deodorizing
• Power brushing
• Optional infill refresh application

Depending on the services you choose, the tools, cleaning agents, and methods used may vary. We do not perform turf installation, repair, or replacement unless explicitly stated in writing.

3. Chemical Use & Health Disclaimer

We use commercial-grade, non-toxic, pet-safe cleaning solutions. However:

• You acknowledge that chemical products may carry inherent risks, including allergic reactions, skin/eye irritation, respiratory issues, or effects on nearby landscaping.
• You agree to keep all people and pets off the treated area for at least 2 hours following service, and 4 hours for small children, elderly individuals, or sensitive animals.
• You must notify us before service begins of any health concerns or allergies.

By allowing us to begin service, you accept all risks and waive all claims related to chemical use or exposure.

4. Results Disclaimer – No Guarantee or Warranty

• We do not guarantee 100% odor or stain removal
• We do not guarantee specific results or long-lasting effects
• We offer no warranty, express or implied, including merchantability or fitness for a specific purpose
• Results may vary due to turf age, drainage, infill saturation, usage, weather, and prior maintenance

You understand and agree that outcomes may vary, and accept the results as-is.

5. Payment Terms & No Refund Policy

• Payment is due at or before the time of service, unless otherwise agreed in writing
• No refunds will be issued once service begins
• A $75 fee may apply for same-day cancellations or if we arrive and cannot access the service area
• Chargebacks or returned payments will result in a $35 fee plus collection/legal costs
• Nonpayment may result in legal action and/or placement with collections

6. Limitation of Liability

You agree that Turf Cleaning San Diego (Wet Sacks LLC) is not liable for:

• Damage to turf, seams, infill, subbase, irrigation, or electrical components
• Injuries or allergic reactions from slipping, chemical exposure, or contact with wet turf
• Damage to personal items left in or near the turf area
• Pre-existing damage or defects in turf, infill, or surrounding areas

Your sole remedy for any service-related issue is cancellation before work begins. You accept full responsibility for any risks after service begins.

7. Access, Gates & Pets

• The property must be accessible, with gates unlocked and pets secured
• We may move light outdoor items (toys, furniture, hoses) to access the turf
• We are not responsible for damage to unsecured, fragile, or valuable items not removed prior to service
• If access is blocked or unsafe, a no-access fee may apply

8. Photo & Video Consent

You authorize Turf Cleaning San Diego to capture photos and/or video of your turf before and after service for:

• Quality assurance
• Marketing purposes (e.g., website, social media, advertising)

No identifying personal info (address, names, etc.) will be disclosed. You may opt out by notifying us in writing prior to service.

9. Hold Harmless Agreement

You agree to hold harmless and indemnify Turf Cleaning San Diego (Wet Sacks LLC), its owners, employees, and agents from any and all claims, damages, injuries, legal actions, or expenses resulting from the services provided, except in cases of gross negligence or intentional misconduct.

10. Force Majeure

Turf Cleaning San Diego shall not be held liable for any delay or failure to perform services due to circumstances beyond our control, including but not limited to:

• Severe weather
• Equipment failure
• Illness
• Labor shortages
• Natural disasters
• Power outages
• Customer-caused delays or access issues

11. Entire Agreement

These Terms & Conditions represent the entire agreement between the customer and Turf Cleaning San Diego. Any verbal promises or external communications are not binding unless confirmed in writing by both parties.

12. Dispute Resolution

In the event of a dispute, both parties agree to:

• Attempt to resolve the issue through direct written communication first
• Submit unresolved claims to binding arbitration in San Diego County, CA
• Limit any damages to the amount paid for the disputed service
• Waive participation in any class-action or group litigation

13. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of California. Venue for any legal matters shall be San Diego County, CA.

14. Acceptance of Terms

By scheduling service, paying for service, or allowing service to begin, you confirm that:

• You have read, understood, and accepted these Terms & Conditions
• You agree this agreement is binding, even without a signature
• You waive the right to dispute these terms after service has started
